A replacement or substitute beneficiary clause is crucial to prevent the estate from being distributed according to intestacy laws (i.e., the laws governing who inherits when there's no Will) if the primary beneficiary dies first.
Types of Substitutes:
- Children of the primary beneficiary: If the primary beneficiary is a child of the testator, the Will might automatically substitute their own children as beneficiaries, unless otherwise stated.
- Other family members or charities: The testator can name any individual or organisation they wish to be the fallback beneficiary.
