For most people, your home or primary residence will be added to your residuary estate, along with your other assets. However, if you answered yes to the previous question, you can provide your legal partner the right to reside in the property under specific circumstances before it passes to your residuary estate. This is known as ‘life interest'. 

It is very important that life interest is provided only to your legal partner. 

Only your legal partner is able to take advantage of potential inheritance tax benefits. If you include someone else this could result in a hefty inheritance tax bill and a potentially complicated legal process. 

This is another area where the law hasn't necessarily kept up with modern life, so if you want to provide life interest to a person other than your legal partner, please contact us for specialist advice before completing this section. It is most likely we'll recommend you create a will with one of our specialist partners so they can provide advice specific to your individual circumstances.
